Employment Contracts and Job Classification Schemes: The Liabilities Employers Miss

The employment contract is the document employers spend the least time on and pay the most for. This is a practical view for owners and HR staff at small and mid-sized companies: what a sound contract must contain, when a job classification scheme becomes mandatory, and which clauses are routinely used against employers in labour and insurance disputes.

What the law requires

Iranian labour law recognises both written and oral contracts, so the absence of paperwork does not dissolve the employment relationship — it only makes the details hard to prove, and that difficulty lands on the employer.

Article 10 requires a written contract to state, at minimum:

  1. Full particulars of both parties, including addresses and identifiers.
  2. The type of work, trade or duties assigned.
  3. The base wage and its associated allowances.
  4. Working hours, holidays and leave.
  5. The place of work.
  6. The date of execution.
  7. The term, where the work is for a defined period.
  8. Any further terms required by the workplace's custom and practice.

Two copies are prepared and one goes to the employee. Missing proof of that handover is the easiest finding for a labour inspector to write up.

Taking a signature or fingerprint on a blank sheet is prohibited. Such a document carries no weight before the dispute boards and is read as evidence of bad faith on the employer's side.

Fixed-term is not a shortcut

Many owners believe that writing "term: three months" lets them end the relationship every quarter without consequence. What actually governs is the nature of the work, not the label on the contract. Where the work is continuous, successive renewals are treated as an ongoing relationship and a refusal to renew is treated as dismissal.

Feature Fixed-term Indefinite
Nature of work Temporary, seasonal or project-based Continuous
How it ends Expiry of the term Only on Article 21 grounds
Evidential burden Employer must prove it was temporary None
Severance Per year and part-year of service Per year of service
Dispute risk High where renewals repeat Low if termination is justified

If the work genuinely is project-based — a construction contract, a seasonal production order — tie the term to that specific job in the text: "until completion of project X under contract number Y". That single sentence changes the defence. The same logic runs through the tax clauses in commercial contracts: ambiguity is resolved against whoever cannot document their claim.

Grounds for termination

Article 21 lists the ways a contract ends: death, retirement, total disability, expiry of a fixed term without renewal, completion of a defined job, resignation, and the misconduct route under Article 27. Anything outside that list is treated as dismissal in practice — covered in dismissal, resignation and unemployment insurance.

The job classification scheme

A job classification scheme is the formal document that evaluates the workplace's roles, groups them, and sets a wage for each group. Covered workplaces above the prescribed headcount must have one prepared by an accredited technical consultancy and approved by the Ministry of Cooperatives, Labour and Social Welfare.

Why it creates financial exposure

The scheme is not an administrative formality; it restructures pay. Once it applies, base wage replaces simple wage: group wage plus seniority increments. Because base wage drives the year-end bonus, severance, leave buy-out and overtime, every increase in it multiplies through the entire payroll cost.

More importantly, the scheme usually has retrospective effect from the date the workplace became subject to it, so wage differentials — and the associated contributions and year-end bonus top-ups — become claimable for past periods. I have seen workplaces defer implementation for years and then meet an accumulated liability that consumed a full year of cash flow.

Implementation steps

  1. List every existing role with its actual duties, not its historic title.
  2. Appoint an accredited technical consultancy under contract.
  3. Complete the job questionnaires with the relevant supervisors present.
  4. Test the proposed grouping and wage tables against the budget.
  5. Submit the scheme to the provincial labour directorate for approval.
  6. Issue new employment orders and file them in the personnel records.
  7. Align the insurance and tax filings with the new wages and clear any differences.

Before signing with a consultancy, ask for the financial impact modelled under three scenarios. That estimate costs little next to the shock of an uncosted rollout.

Clauses that cost money later

  • Net rather than gross pay. Contracting a "net monthly salary" transfers the employee's tax and contribution burden to the employer, and every rate change raises your cost.
  • Vague duties. Without a defined job description, proving misconduct for a justified termination is close to impossible.
  • Uncapped benefits. Language such as "bonus at management's discretion", once paid a few times, becomes a recurring benefit and attracts contributions.
  • Silence on location. With no stated place of work, a later transfer can be characterised as a unilateral change of terms.
  • No disciplinary policy. Without an approved policy, relying on Article 27 to end a relationship has no foundation.

The contract in the tax file

The contract is not only a labour document. In a tax assessment it is the basis for accepting payroll expense, and in a social security inspection it is the basis for the contributory wage. An employee on the payroll list with no contract draws the same finding from both authorities. For directors, the employment relationship must be documented and kept distinct from the shareholding one — see director remuneration.

Key takeaways

  • No written contract does not mean no employment relationship — only a harder defence.
  • The nature of the work, not the contract label, decides whether the term is genuine.
  • A classification scheme changes base wage, and that change multiplies across every benefit.
  • Vague benefit and duty clauses harden into permanent obligations.
  • The same contract is read by the labour office, the insurer and the tax assessor.

Frequently asked questions

Does an employment contract have to be in writing in Iran?
Oral contracts are legally valid, but the absence of a written one always works against the employer because the burden of proving the term, duties and agreed pay falls on them. Sign two copies and give one to the employee with a receipt.
Does repeatedly renewing a fixed-term contract make it permanent?
Renewal alone does not convert the contract, but if the underlying work is continuous in nature the dispute boards treat successive renewals as evidence of an ongoing relationship and read non-renewal as dismissal. The employer must be able to document why the work was genuinely temporary.
When is a job classification scheme mandatory?
Workplaces covered by the Labour Code whose headcount exceeds the prescribed threshold must prepare a scheme through an accredited consultancy and have it approved by the Ministry of Labour. The headcount threshold and procedures are set by ministry directive, so confirm the current rules before starting.
How does the seniority increment differ from severance?
The seniority increment is an annual addition to current wages, set by the Supreme Labour Council, for employees with at least one year of service. Severance is one month of final pay per year of service, paid when the relationship ends.
Can we agree to pay below the minimum wage?
No. Any agreement setting pay below the statutory minimum is void even if the employee signed it, and the shortfall remains claimable later, typically together with the associated contributions and penalties.
