Employer Social Security Duties in Iran: Lists, Ledger Inspections and Article 38

If you employ even one worker in Iran, social security obligations start on day one. Contrary to what most owners expect, the heaviest liabilities rarely come from the monthly list itself — they come from ledger inspections and from subcontracting. This is the employer's view of contributions, filing, inspections and clearance.

How the thirty percent breaks down

Component Rate Borne by
Employee share 7% Withheld from wages
Employer share 20% Employer
Unemployment insurance 3% Employer
Total 30% 23% direct employer cost

The legal point worth internalising is that the employer is liable for the entire amount. If you failed to withhold the employee's seven percent when wages were paid, the organisation still collects it from the company; failure to deduct is not a defence.

What sits inside the contribution base

The social security base is not the same as the payroll tax base, and that gap causes most reconciliation problems.

Contributory: base wage, cash housing allowance, food allowance, job and attraction premiums, overtime, shift and night premiums, and recurring cash benefits generally.

Non-contributory: year-end bonus, unused leave buy-out, severance and end-of-service entitlements, child allowance, travel and mission allowances, marriage and funeral assistance, and nursing allowance.

Build a one-page mapping table showing, for every pay element, its tax treatment beside its social security treatment. That single sheet resolves most disputes during inspections.

Deadlines and penalties

Both the list and the payment are due by the last day of the following month. Late filing and late payment are penalised separately, under the statute governing employer fines. Rates and amnesty conditions are periodically adjusted by circular, so before settling an old liability, confirm the current waiver terms with your branch.

If no list is filed, the organisation may assess contributions on its own estimate. In the cases I have handled, that estimate is almost always higher than reality, and reversing it takes months of documentation.

Monthly employer checklist

  1. Finalise the payroll and split contributory from non-contributory items.
  2. Register new hires before month end and obtain their insurance numbers.
  3. Record exact termination dates so extra months are not assessed.
  4. Upload the list and save the tracking code.
  5. Pay the contribution before the end of the following month and file the receipt.
  6. Reconcile the insurance list against the tax list for the same month.

Ledger inspections

The organisation may examine the workplace's statutory books and financial records. The inspector is looking for one thing: payments that are wage in substance but absent from the insurance list. The recurring findings are fees paid to individuals without a clear contract, bonuses paid from petty cash, "service" charges that are really direct labour, and seasonal or daily workers with no insurance file.

This is why the quality of your statutory books is not only a tax matter — it directly drives insurance exposure. If books and supporting documents are not produced on time, you lose control of the assessment base.

Booking production or project labour under headings such as general expenses or contracted services is read during inspection as concealed wages, and contributions plus penalties follow.

Article 38 and subcontracting

Article 38 is the costliest provision for employers who outsource work. The principal must retain five percent of each progress certificate and hold the final instalment until the contractor delivers a social security clearance certificate. Skip that step and the contractor's unpaid contributions become collectible from you.

Contract contributions are assessed using approved coefficients, and the coefficient for labour-only contracts is substantially higher than for contracts where the contractor also supplies materials. How the contract is drafted therefore has a direct financial effect — the same lesson that applies to tax clauses. For sector detail, see contracting accounting.

Getting to clearance

  1. Draft the contract with an unambiguous scope and price.
  2. Notify the branch of the contract within the prescribed period.
  3. File project payroll lists under that contract's workplace code.
  4. On completion, apply for clearance with final progress certificates attached.
  5. Review the assessed difference and object within the statutory window if it is wrong.

Objecting to an assessment

After a demand notice is served you have a defined window to object; the file goes first to the primary claims board and then to the appeal board. Cases that succeed are the ones with the basic evidence in place: employment contracts, signed payslips, progress certificates, bank payment records, and books that show the same figures. Without those, arguing about what "really happened at the workplace" carries no weight.

Key takeaways

  • Contributions total 30 percent, with 23 percent a direct employer cost and full liability on the employer.
  • The insurance base differs from the tax base; map every pay element once.
  • File and pay by the last day of the following month; two separate penalties apply.
  • Inspections of the books, not the monthly list, create the large liabilities.
  • Never release a contractor's final instalment without the clearance certificate.

Frequently asked questions

What is the employer's social security contribution rate in Iran?
Total contributions equal thirty percent of contributory wages: seven percent withheld from the employee, twenty percent from the employer and three percent unemployment insurance also borne by the employer. The employer therefore carries twenty-three percent directly.
When is the monthly insurance list due?
The wage list for each month must be submitted to the Social Security Organization and the contribution paid by the last day of the following month. Late filing and late payment are two separate breaches carrying separate penalties.
Which allowances are outside the contribution base?
The year-end bonus, unused leave buy-out, severance and end-of-service pay, child allowance, travel and mission allowances, and marriage or funeral assistance sit outside the base. Cash housing and food allowances are inside it.
What does Article 38 require from a principal employer?
When work is subcontracted, the principal must retain five percent of each progress certificate and the final instalment until the contractor produces a clearance certificate. Without that retention, the contractor's unpaid contributions can be claimed from the principal.
